My lawyer just informed me that my application will be subject to random selection because it was received on the 26th of May. I am in my final yr of residency and I am going to Texas so I had to apply without the License because I can only get it after 3yrs of residency. My question is do they normally issue RFE for the License?. Can Physicians apply for the 20000 US graduate cap?
 
J1 waiver candidates who are accepted in the Conrad state 30 program are H1b cap exempt. So you can file your paperwork even now.
 
I am currently on H1 for my residency and I am joining a group in Texas that falls under the cap starting oct 1st. The INS release says the cap is reached and the applications received on the 5/26/06 will be subject to random(computer) selection and mine was received on that day.
 
Where is the hospital that you are going to work at? Sometimes you can claim cap exemption if the hospital is non-profit with teaching affiliation. Nonprofit would be listed somewhere on the hospital web site and teaching affiliation is relatively loose, like nursing students rotating or something like that. If they have a residency even better.

What are you going to do about the gap between July and Oct anyways? If your job is cap exempt then you should put the start date July 1st so you won't have a gap.
