H1 portability question

Hi

Under the portability provision, is a h1b holder allowed to start working for a new employer immediately upon filing the new h1 petition or is it after the new h1 petition has been received by the INS?

I am planning to send it by overnight delivery so we are just talking about a difference of one day. However I wanted to know definitively if the first day I am allowed to start working is the day I file the new petition or the day the INS receives the petition.

It is always better to start working once USCIS send you a receipt with WAC or LIN number. Otherwise any loss of your petition by mail/courier, you are responsible not USCIS.

You must have a prrof from USCIS that they have received your petition and issued a receipt with reference number so that you can track your petition before moving to new company.
