H1 portability from cap exempt to 20K quota

Hello

I am currently on a H1-b from an university
I have offer from a company and so had a question regarding portabilty of my H1 from university to this company.
H1 from university is cap exempt and that from the company will be under 20K quota since i have MS degree
The company has applied for my H1 and their attorney has told me that i can join immidiately under the h1 portability clause.
as i understand my new H1 will be valid from oct 1
so do i need to wait till then to start work or should i believe what the attorney says.
please help
 
This is tricky. Wait until the H1b approval. If INS put start date immediate you have no problem otherwise Oct 1 2006 is your start date.

Since you are under 20K quota, you probably not allowed to start work imeediately non-exempt sponser.
