h1 or h4 to enter

hello,
if currently in h4 visa-h1 papers approved to start in october-do we have to go to india for stamping the h1-or start working with h1 approval

This is a confusing issue.

There are actually two H-1 items. Let's call them the H-1 permit and the H-1 stamp.

Posession of the approval letter for your H1 is the only document you need to live and work in the US. This is what keeps you 'in status'. I call this the H1 permit.

The H1 stamp is the thing they put in your passport. It allows you to enter or re-enter the US - that is its ONLY function. Thus, if you never intend to leave the US and re-enter then you never need the H1 stamp in your passport.

Clearly, an H1 holder coming from India would need the stamp and the permit. But, if you are already in US you only need the permit. Is this clear? :)

----- did you or your employer filed from H4 to H1 CHANGE OF STATUS?

** did you get new I-94 attached with your H1 approval notice??
