H1 or H4 Please help!!!

couldn\'t find an exact explanation to my problem from the faq\'s. Please help me!

    I came to US on a H4 Visa. Later when my husband changed his company I
         was issued another H4 approval notice with valid I-94 till dec 2003. Afterwards I applied for a H1B here and was issued an H1B
        approval notice with valid I-94 and got my SSN#. However due to certain health reasons I couldn\'t join the company. Its been 10 months

        till now that I got my H1 B notice and I\'m not sure when I\'ll go back to work. What is my legal status now.?
        1. Will the fact that I posess a H1B and am not working cause any legal problem.?
        2. If there would be a legal problem what is the best thing I can do.?
        3. If I go to India can I return through my H4. If I can then what would happen to my H1 approval?

1. You have status problems. Since without a paystub H1 is considered invalid.
2. Change back to H4.
3. You can go out and come back in H4. Make sure that you get the appropriate stamp in the passport. Your H4 to H1 will be nullified, since you would have used H4 at the POE as status. If you want to work you have to do H4 to h1 again.
