H1 or EAD

Hi:

My H1 expired on Feb 25,2001 and I got my EAD in Jan 2001 valid till nov 2001. I have I-485 pending with INS .

My question is EAD by itself a legal status or do i need to extend my H-1 for one more year till i get my green card approved to remain legal in US.

EAD is a valid legal document. Hvaing filed I-485, you are in AOS status and do not require to maintain your H-1B

You do not need H1. Your status is "Waiting for AOS".

AOS is Adjustment Of Status. EAD is required to work. But you are allowed to stay here legally without EAD because you are in the status "Waiting for AOS". But, if you are not working while on this status, INS may ask you what you were doing for living. If you lived on governament money while waiting, your 485 approval may be affected. Remember INS checks for a current employement (income) by issuing RFE to many 485 waiters.
