H1->L1A->H1 Am I Subject to H1 Cap ?

I came to H1B in MAR-2001 From A Company.
Transferred to L1A in DEC 2003 by same company so current status is L1A.

Can B company apply transfer from L1A to H1B ?
Will that be subject to H1B cap ?

AC21 says if person not eligible for another 6 year H1 term, should not be counted to H1B cap.
Is that applicable to me ?

Looks like you may not be subject to the cap.
