H1 & L1 - Visa interview

My wife is going for L1 visa interview at Chennai consulate in the month of September. I am thinking of applying for H1B at NSC to be counted in FY06 cap. Can the visa officer interviewing my wife possibly know that there is a pending H1B petition for the same applicant? Can something like this pop up in his system? This assumes Consulates and USCIS share the information, which they probably should.

Please comment.

Your H1 will be new one. Until it is approved intimation will not go the concern embassy.

However your wife can not work on H1 once she come with L1 to US unless she get her visa (h1) stamped in her pp and I 94 should have caveat of H1.

Because you are not changing the status from L1 to H1, you are making a new H1. (Careful)

Do you know, without your knowledge any company can apply H1 for you, if they have some basic information/CV about you?
 
COS in US

I understand that it is a new H1 and the applicant will not be able to work on H1 when entering US on L1. Can we not do a COS from within US to get I-94 for H1? If not from US may be in Canada?

You can apply one more H1 which may be COS to get I 94 caveat H1.

When we apply one more H1 to get I94, will that application be counted against the cap? It is certain that H1B cap for FY06 will be reached in the next few days.

Also, do you think we have to pay all H1B related fees or just the application fee?

This is new H1 all the new H1 rules apply. Complete fees to be paid (including attorney's fees) , cap, quota etc.
Yes Quota is going to exhaust soon, you have to go for premium process.
