H1 Issue

Hi,
My Issue is i am with an employer for the past 1.5 years and i came to US in March 2008, since then they are not generating my payroll, and i am on project from Jan 2009 and since then they did not even pay me a single penny and not at all running my payroll. If i ask them they say we will do in couple of days which is not happening.
I want to take some kind of action on them but dont know what to do.

I am also planning to transfer to another company but it needs payroll, I am kind a stuck in real bad situation.
Can anybody suggest me what would be the right plan to get rid of them.

---------------------you cant file H1 transfer as you are out of status(no pay stubs). USCIS may reject H1 transfer as you are out of status.

Can anybody suggest me what would be the right plan to get rid of them.

You can file complaint with DOL. DOL will recover your all the wages from the date you joined employer. DOL will also investigate the H1 employer and they may also fine the employer and employer may not be able to file H1 in future.

Sorry for the late response...
I have one more doubt ....As i was on bench for a long period will it affect me if i complain to DOL as they are gonna check my status and other related documentaion.....

It is not your fault. It is employer mistake not to pay you and keep you on bench. File complaint with DOL and DOL will recover your wages and employer can be fined for not paying you.
