H1 invalid if person is out of US for more than a year?

Hi all,

I have a special case, might have alreday been discussed in this forum.
My wife had a H1 through a very good company 2 years back. She came on an assignment in US and went back to India and left that company and joined a new company.
When I tried to get her old H1 transferred USICS said to apply in new quota. Is the old H1 invalid if a person has not entered in US for more than a year?
She is on an H4 here now.
What possibilites do I have to get her H1 transferred? Is it even possible? Do I need to take an attorney's help?

Her H1 may not bet transfered , but you can change the H4 to new H1 by submitting old H1 reference. It will not come under quota.
