H1 holder can work with 2 companies!!!

Seasons Greetings,

A) Presently I'm working with company 'A' as a permanent employee. This company processed my GC in RIR, 1st step of Labor from Common Wealth of Viriginia, on May 2002. I heard that presently VA Labor working on May 2002, 1st week applications. Totally, it may take another 6 months to receive labor approval from FEDERAL. (I may loose job with company 'A' on closing Government Contract in anohter 5 months or so. Not sure, if the contract closes, then they may say good-bye at any time or we may get extension.)


B) Anticipating the above problems, I have applied H1 & GC process with a CHICAGO based company 'B' in the month of July 2003. I'm hoping that, I may get labor approved from Chicago in January 2004.

Here I need your suggestion/advice:

1) Having H1 with 2 companies, can H1 holders work simultaneously for 2 companies?

2) Is there any problem in receiving paychecks from two companies on full time basis?

If above is not a problem, then I'm planning to work with both companies 'A' & 'B', and continue GC process (concurrent, 140/485) with Chicago company 'B'.

Note: My H1 period (6 years) ends with April 2004.

Your advice is greatly appreciated,

NOTE: One can carry more then one H1 at the same time from different employer. This is called "concurrent employment" and the attorney can file the I-129 to reflect this. There is technically no limit to the number of companies for which an individual can concurrently work, all of the requirements, including Labor Attestations, etc., must be filed for EACH AND EVERY employer.

Simultaneous is also a question.
 
Possible: Yes. If USCIS approves two H1-B for fulltime employment.

I doubt they will ever do that though.

Even if they allow it legally. Please think twice before doing anything. You know there are so many US citizens who don't have jobs etc.....
