Hi,

I had my h1 from oct 2008, but as i couldnt get a job , i travelled to india and came back in h4 in june 2009.

Now i am getting some interview calls and i want to the various options i havae if i need to work

1) can i work in my old h1 ? If so , do i need stamping or my employer can apply for cos?

2) Can i get a new sponsor for h1? If so, do i need to go for stamping or he can apply for COS?

3) What is premium processing ? can i start working immeiately after i get the reciept incase i am going for new h1 or wait for approval?

4) wht are the documents i need to submit?

5) As i was out of status from oct 2008- feb 2009 , will it effect my new h1.

Thanks in advance , its very urgent as i am gettig couple of inteview calls.
 
Your employer can file new petiton not under cap with a COS. You may NOT work until you receive an approval notice. If the petition is approved but COS is denied, you will need to get stamping.

You do not submit documents to the USCIS for petition - only to consulate for stamping.

Since you have had the problem of being out of status already, be sure any employer is a real one with a real position - not one that may come to be.
