We have a situation with me and want to know some clarification on it. My wife has applied for H1 renewal with her employer and it is under processing. Her I-94(with his old H1) has expired in Aug 1st 2002. We are still waiting for approval.
My questions are:
1. Can any company apply for a H1 for her?(He has the current pay slips from his employer), before the renewal?
2. If the H-1 rejected (hope not, but got RFE and responded), then what will be our options? i.e. can she apply for H-1 or H-4 immdediately?
