H1 Gap period

Between my current h1b and new h1b there would be a gap of 10 days. Would this be a problem? pls advice?

During those 10 days could i continue to stay within US? i wouldnt be working for those days.

In the situation that my new h1b petition remains pendind(in-process) at that time, would i be able to continue to workin that 10 day period? both h1bs are for the same employing institution but different jobs.
 
If your I 94 is valid during those periods, you can stay in US and work for the sponser.

my I 9 would not be valid. My I94 expires the day my visa ends. My new visa begins after a period of 10 days..
