H1 for Residency (Critical Problem)

I am on H4 since May 2000. I am trasferring my H4 to H1 for my residency program. I don't have EAD and expecting around 2008.
Since Residency is 3 yrs program ( I can have my H1 up to May 2006) what will be my status in Residency during 2007 & 2008. How can I complete my residency. I know I can't get H1 ext after May 2006 . I got many interviews but wondering about my H1 visa. How it is going to work for me.

Any suggestions/ideas Pls.
 
Get an LC filed early during residency. Once it is pending for more than 1 year, you can file H1b 7th and 8th year extensions. This doesn't have to be a company/practice actually interested in hiring you, they just have to file the stuff. If it gets approved (maybe through PERM), you can file an I140, and use that for extensions.
 
Thanks for your kind response. Actually, Community Hospital "A" is sponsoring H1 for me. Can apply for LC through company "B" having H1 with hospital A.
Actually my H1 is not yet approved. Do you thing it is possible to apply for LC , just having H4 and USMLE certification through non-health organizations. If yes, that will be greatest help that some one can offer me.

H1 for residency(critical problem)

I am in the same boat.Will get only 1 year to do residency in H1.Do you have prematch offer.Have you mentioned this to the program.I am desperately seeking for help regarding this .If you get further information please post here.

I am not sure. From what I understand, the LC filing used for an H1b extension doesn't have to be from the company that sponsors the H1b. Be sure to check on that. There should be something in the section of this BB that all the IT professionals are milling around in.

You can have an LC filed for some sort of 'technician' position. It doesn't have to be for a physician position.

1. The ALC (alien Labor Cert) does not necessarily have to be from the same company that is sponsoring the H1.

2. with a pending Labor cert application, and to use that to get an H1 extension, implies: ... you are declaring to USCIS that... you will be working in the SAME FIELD after getting your GC and that is the reason CIS should grant extension of your H1 status.
so if you file your labor cert in some unrelated field (to your H1), CIS may deny extension of your H1 status.

ok, so I guess it would be most helpful to find a practice to sponsor you as 'physician general practice' then. All you need for that is USMLE 1-3 and 1 year of experience.
 
Hardan, J1victim or anybody...Suggestion Please

I am screwed... As I mentioned in my previous Faqs, I got only one year period for my H1B work permit. Since I came to USA in AUG 2000, my H1B will be good till AUG 2006. I have been on H4 status for almost 5 yrs. actually my wife is a primary H1 visa holder and she is going to apply for her 7th year extension in Aug 2005. She applied for GC in Jul 2004 (IT professional-EB3- NON RIR). There is no way that we will get our EAD before AUG 2006 (My H1 visa exp).

Now what will be my situation after AUG 2006? What are the other options...As Hardon said, can I apply for LC and get 7th, 8th year ext in order to complete my 2nd and 3rd year res. Is it possible to get H1 visa ext based on my pending LC, even though my wife has already been applied for LC in 2004, and 7th yr ext in 2005. I strongly believe we will be in critical situation in Aug 2006, where I will need 7th year H1B ext and my wife will be required 8th yr H1b ext.

I need all possible options and the best suggestions...I don’t want to get in to out-of-status situation. I will be joining residency with in two weeks and don’t know what to do after one year…Please provide me some valuable/helpful info so that I will not loose my hope.
 
One possibility

One possibility, depending on your family situation and willingness of the residency program:
1. Do one year of residency, then either go to Canada(get into some research program) or some country outside US for 1 year. Reapply for H1B. You can get 6 years on the new H1B(if the program can help).
