Hello,

I am on an H1 visa and currently working. I am also studying M.S. part time. (I have finished one semester).

Can anyone tell me what is the procedure for switching from
H1->F1?

It is a simple procedure, Take allthe necessary documents to the school international officer, he will file for u for the change of status from H1 to F1, there will be some fee abt 120 dollars i think so.So check with u re internatinal department in school they will take care of that.
Think one more time before changing of status, that is a non immigrant visa, and in the change of status there wont be multiple entry , if u need to go to india in near feature then u need to get stamped on your passport for F1, so think all the things as per the situatuation and go for that.

Can you tell me what all the necessary documents are?
I will also follow up with my International students department.

Also, if I were to get laid off, then I would need to remain in the country until the next semester starts. Is this allowed? Or would I have to return to my home country if I am no longer working for my employer on H1 status?

If you have a change of status (H1 to F1) application pending at the time of lay off, then you can stay in the US until the INS processes your case. Even otherwise short overstays like 10 days are generally overlooked (but dont quote me on this). Moreover you are safer if the date on your I-94 has not expired.

Once you change to F1, you cannot normally work for the employer unless you get work authorization beforehand from the INS. Usually that would mean being in F1 status for at least 9 months, and then applying for practical training.

Documents: File I-539 with supporting documents (see www.ins.gov, and follow links to forms, see instructions for that form).

I was more interested in knowing if I can start this process AFTER a possible layoff. What are the implications then?
If it is possible, then within how many days after a layoff should one file for an H1->F1 transfer?

A new set of questions.... :)

I was working for company A and that company closed down in december. Immediately after that I filed for an H1 transfer to company B. That application is pending with INS. Now to further complicate the scenario I have an opportunity to start MS program fulltime next week ( 13 jan ). So is it OK to apply for an F1 along with my pending H1 transfer ? How will the new submission afect my status?

Can I start studying immediately? ie without waiting for the F1 approval? And when do legally qualify for taking assistantships?

Any help in this complicated problem is appreciated..
