Hi Rajiv,
I am currently working for a company on my OPT which will expire on July 1st. My company wants proof of legal status from July 1st to Oct 1st for them to file H1B application. Accordingly, I would highly appreciate if you could address the following two questions.
1. My employer's lawyers say that they are expecting an announcement around April 1st from the INS that would grant legal status for H1 B applicants during the interim period (from the opt expiration date till H1B decision). Do you also expect a statement from the INS in the next couple of weeks? Or, have you heard anything along these lines from AILA-INS communication?
2. As an alternative I have secured an admission in a university here, but have not yet initiated the transfer of my F1 status from my previous university to the new university. My classes are scheduled to start from June 28th. I am planning to initiate the transfer and new I-20 process immediately. However, there is also possiblity that my H1 application may be filed between April 1st and June 28th. I heard that if my H1 is filed before my new I-20 is updated in the SEVIS system (which could be before June28th, as early as May 28th), there is a possiblity of my H1 and F1 applications cancelling each other. Could you please clarify if this is true.
If so, should I wait till June 28th before my H1 is filed or it can be filed as soon as my new I-20 is updated in the SEVIS system. Or, can it be filed even before the new I-20 is issued after initiating the transfer process.
