Currently Im on H1 with a company A and I have to apply for extension.Recently company B also applied for H1 but while applying they mentioned that I need to go out of US.Now that H1 has been approved but I wont join company B.I want to know will be there any problem for the extension from company A because the H1 from company B is like I was out of status so I have to go out of US.Company B filed in california and company A will file in nebraska.

----It means the B applied your H1 as NEW H1, if you want to work with B go out of US, get H1 stamp then enter with newI-94
Now that H1 has been approved but I wont join company B.

----------- If you are still working with company A and have recent pay stubs just send your H1 extension, I don’t see any problem for you. You are eligible to extend H1 trough A.
------ If you don’t want to join company B no problem for you.only the employer B lost H1B filing fees and lawyer fees and you never forced him, you are OK just file H1 extension through A before I-94 expiry date, one can file H1 extension 6 months advance

Ginnu,

Is it OK if we file the H1 extension 10 days after I-94 expiry. Is there any such provision in the H1 extension law with the same company. Will there be any problem if its 10 days after I-94 expiry.

Thanks
