H1 Extension Question

Hi,
I transferred my H1 from Company A to Company B. I've got my I797 as well. My first extension is coming up; only I don't have the visa stamped to Company B!!! If I go for extending my visa with the approved 797 petition, will I face any problems?
Also, can I get an H1B extension done in Canada ?(I'm an Indian citizen)!!

Thanks

It doesn't matter if you H1 visa in your passport is not based on the company B. As long as you have the valid I-797 for company B, you can go H1 stamping for company B.

Yes, you can get H1 stamping done in Canada.

Hi Thanks for the reply,
A little help : my second question was a little more specific.

Since I haven't got a stamping done from Company A to Company B :
Is getting an extension a two step process in my case?
ie 1) Get the stamping and 2) Get the extension? (ie two separate interviews?)

Also, Can Extension be done in Canada? I understand now that the stamping can be done in Canada - I'd heard that for extension one has to return to one's home country so I'm confused : Please clarify!

Thanks

Applying for H1 extension is different from getting H1 visa. You can apply for H1 visa based on an approved H1 or H1 extension which is filed by the employer in US. In terms of applying for H1 visa, there's no difference between the first time H1 or H1 extension.
I believe you can certainly apply for H1 visa based on an H1 extension approval.

I'm not clear on the question you are asking about two step process. If you never had an H1 stamp from company A and now have H1 extension from company B, I think you can still go get H1 stamped even though you never had stamping done for company A.

Some consulates in Canada like the one at Halifax, NS do not process first time H-1Bs. Please check the consular website for details. For extension, any consulate will do.

I see.
So to sum it up - since an H1 extension isn't application for a brand new VISA, I can *safely* get my visa extended in Canada despite being a citizen of another country?

Am dense about this whole procedure so apologies if my question has already been answered - just trying to make sure before I apply.

Cheerz
