My H1B 3 year extension is still pending. The case status online is "received and pending. On November 1, 2006, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice."
I have been following online forums and trackers and the processing time for the CA service center and they have been processing cases received around the end of October and beginning of November so an update on my case is due soon.
My current H1B expires but on 14th Feb. I have a couple of questions/concerns
1. Is it a good idea to upgrade the application to premium processing at this time ?
2. If the approval/Update doesn't come by 14th Feb, Do I/My company have to do any paperwork ? I'm aware of the fact that I can continue working for 6 months after the expiration, as long as the renewal application is still in process.
3. Worst case scenario, If the extension gets rejected What are my options then ? Can I appeal and if I do, can I legally work till I get an answer ?
