I'm currently in the 4th year of my h1 which will expire by early mid next year. My team is being spun out as a new company. This company will apply for for my extension with the h1 approval petition from my parent company.
I have a GC (485 pending) filed and an approved EAD but i want to hold to my h1.
my attroney says, with the 'successor of interest clause', the spin off company does not need to file a h1 transfer from the parent company and there will be no impact to my GC filed by the parent company.
Has anyone done something similar? please share your experience.
