H1 extension aproved H4 didn't filed for extensioin

hi,

I got h1b extension upto June 2006. my current visa valid until July 2005. my wife's h4 is valid until july 2005. lawyer forgot to apply my wife's h4 extension. i'm planning to go canada for visa stamp. can i get my wife's visa stamp along with mine with only showing my extension approval ONLY.

------ did you inform lawyer that you have a spouse on H4 and H4 need to be extended with your H4? that way if lawyer could have filed her H4 extension approval with your H1 ext in the same envelope

--- if Canada is your home country I think she can do it, if not then it is risky
best option:she need to file H4 extension with USCIS with form I-539 and it should reach USCIS BEFORE her I-94 gets expired. file her H4 extension ASAP, she will get H4 extension till your H1B and will get new I-94 extended and attched with H4 extension approval.

** why do you need to go for Visa stamping? if you have got H1 extension with I-94 attached with approval notice ( lower Right side of approval notice) you dont need new Visa stamp to work or remain in US. if your passport Visa is expired then you can get it stamped next time when you go out of US

I got h1 extension until 2006 automatically with h1 transfer.
Should i get it stamped since changed my employer with extension?
Regarding my wife case, I was thinking to go canada for my visa stamp and get my wife's stamp also at the same time. The money I spend for lawyer for my wife's visa extension could be used for my family canada visa trip.
what are the risks for getting my wife visa stamp at canada showing my extension approval? Are they going to ask for my wife extension approval as well?
i heard if visa get rejected in canada is going to deny us to reenter USA. is it true (having valid visa and i-94 valid untili jul 2005)?

---- Visa stamping in Passport NOT needed if you got I-94 attached with your H1 transfer approval notice( lower rightside) you can remain and work in US till the date you have new I-94

--dont take the Risk of her H4 visa stamping in Canada, if Visa in Canada got rejected she will not be able to enter US from Canada. FYI you can directly file H4 extension without the help of lawyer if you are expert in filing , if not then take the help of lawyer and file her H4 extension ASAP

---That is true and it seems to me that you are NOTcanada citizen, if YES then your wife need to file H4 extension with form I-539 BEFORE her I-94 gets expired, I will file NOW as her I-94 is going to expire in July 2005(one can file 6 months advance of I-94 expiry date)
