H1 Extension Approved with (approved) i-140 !!!

My H1 case is a bit strange in the sense that, my labor was filed when I had only 8 months left on my H1. It was approved in 2 months....after that, the company filed my I-140 thru premium processing and got an RFE then replied, got approved. It took another 2 months for that.

And my H1 which was coming to an end, had actually a wrong expiration date in it. Instead of May2007 it has may2008. That was another problem with my H1. I don't know for sure if it was a mistake from the attorney, who forgot to do all the calculations when they filed for extension, or USCIS error....i don't know.

But anyways, As soon as my I-140 got cleared, my company filed 7th year extension of H1. But the date when they filed the ext. was june/19/2007 which was beyond my 6th year. I had traveled to my home country in the past for about 40 days...so we just assumed that I had time till july1st week, within which I had to file my H1 even though I didn't had it on the H1 document itself cause, as i stated earlier, I had wrong dates in my H1 paper.

Finally, after 5 1/2 moths my H1 is approved!!!!....i got a RFE, which the attorney answered, I don't know what the RFE was for, since nobody asked me any documents. I was just checking the USCIS website with my receipt number ever week or so.

My 7th year H1-Extension is approved.

I must thank this forum for good support. Whenever I had any doubt or question, I get answers and lot of hope.

The best process would be to file for an extension with recapture time (about 40 days) followed by filing of the 7th year extension before the expiry of recapture time. My employer did the above for myself (in December 2005) and got these approved wiothout any RFEs. Both petitions were regular processing and both were approved in 3 months timeframe.

You can actually club them together. Why do you want to pay 2 times for H1 Extension when you know you could get a 3 year extension, based on your approved I-140.
