H1 extension after AC21 a problem?

I posted this same Q in the H1 arena but I thought I would pick your brains too.

I changed jobs in Aug. I am on the last 3 months of my first 3 year H1-B1 Visa. I did the AC21 correct. When I apply for a 3 year extension, will listing my new employer as my sponser raise flags? I don't mind the REF's for employment, etc. I just don't want to blow this at this stage.

I went from TN from Canada back in 2002 to a H1B1. We have been going through the whole Green Card process and are just about done. They said the would inform us about their decission by Nov 12th (60 days after we sent them info from RFE). They just sent us another RFE for marriage and birth certificates. We dont have them back yet. My H1B1 expires on Feb 2, 2007. It takes about 90 days for them to approve an extension (for the last 3 years of an H1B1). In Aug, I changed jobs and did the AC 21 paperwork to BCIS about my new company. Since I am running out of time to apply for an extension for my H1B1, I need to apply soon. I need to have my new company listed in the extension. Will having a different company than the origional sponsoring company sign cause problems?

---what was the RFE? RFE for I-485 or EAD or AP???
They just sent us another RFE for marriage and birth certificates. We dont have them back yet.

My H1B1 expires on Feb 2, 2007. It takes about 90 days for them to approve an extension (for the last 3 years of an H1B1).
-------------one can also get H1 extension in 15-20 days if filed through Premium processing, if filed normal processing it may take 3-5 months but once you file H1 extension Before I-94 expiry date you will be safe

Thank you ! As far as the H1 transfer...All I did was write them a letter claiming AC21 and supporting documents staing that I can. Also submitted a letter from the new employer with the job details and pay. Is there a form I need to submit for the H1 Transfer? I thought that all I had to do was claim AC21.

------------------BEFORE you joined new employer that employer was supposed to file H1 transfer with USCIS with form I-129,copy of LCA, fee, copy of your recent 2-3 pay stabs of past H1 employer. you seem to be confused or dont know much about H1 transfer better go to your Lawyer with all your papers and explain your situation .

I thought that all I had to do was claim AC21.

Follow up. Others please comment too.

OK....Here is my cover letter on my new company letterhead that I sent to BCIS. Also below is my Supporting Letter. I have scoured the boards and did severa posts and others think this is sufficient. Let me know if you think it is sufficient.

This letter is in regards to the I-485 application for adjustment of status filed on my behalf by (My Old Company.

On February 8th, 2005, my I-485 application was filed based on pending Form I-140
by my former employer, (old company) with Receipt Number LINXXXXXXXXXX. My I140 was approved on June 8th, 2005. I was lawfully employed with (old company) pursuant to the Employment Authorization Document (EAD) issued on my behalf in conjunction with my I-485 application. I recently took a position with (New company) in the same field as my previous job. It is a similar position and with same job duties. (Attached for your reference is Employment Verification Letter from (new company))
The American Competitiveness in the Twenty-First Century Act of 2000 AC (21) allows for a change of employer on any I-485 Adjustment of Status Application that has been pending for 180 days or more, without the need to file a new I-140 petition. (Attached for your reference are relevant portions of AC21.) On August 23rd, I changed employers from South Dakota Wheat Growers to Watertown Coop, as my I-485 had been pending beyond the 180-day period required by law.
According to the Memo released by William R Yates on August 4th 2003 the I-140 is valid if it is approved and form I-485 has been pending for more than 180 days even when the employer withdraws the approved Form I-140. (Attached for your reference is the Memo on August 4th 2003 from William R Yates) (Old Company) has told me they would not withdraw my I-140.
In light of the above, I maintain that I have lawfully changed employers pursuant to the American Competitiveness in the Twenty-First Century Act of 2000 (AC21) statute, and that my I-485 application remains valid. I respectfully request that your office should adjudicate my I-485 accordingly under AC21 provisions. Should you have any further questions, please do not hesitate to contact me.

if you have sent the above letter to USCIS with new employer permanent job offer letter of same/similar job then you have sent request to invoke AC21 with your Pending I-485.

It is NOT H1 Transfer. H1 Transfer has to be filed by new employer/lawyer with Form I-129 with USCIS before you join . one CAN join on H1 if the new employer filed H1 Transfer and the petition reach USCIS Before you join.

*** you are mixing H1 transfer and invoking AC21 with pending I-485

** if you have valid EAD then you are ok to work with new employer.

if no valid EAD and the new employer has not filed H1 transfer for you BEFORE you joined it may be Unauthorized employment. talk to your lawyer.
* if you have used EAD then you are NOT on H1 status

So, come Feb 2nd, when the EAD and first 3 years of H1B1 expire, what do I do? Do I apply with an I-129 for a three year extension on my H1B1 with my new employer or just apply for another one year EAD....or both?

Is the EAD not designed so I can work while my I-485 is being processed? (Day 683 now, by the way.)

What to do...EAD, I-129 or both?

-------------you need to file for new EAD NOW (it takes 4-5 months for approval) you are not on H1B status as you used EAD

------------------ you can work on EAD and need always valid EAD for work. file renwal of EAD 6 months advance of EAD expiry date. if you go out you will need AP to come back. file the AP and EAD both.

------------- file EAD and AP. for EAD form is I-765 and for AP the form is I-131.

Has your new employer filed the H-1B transfer? If so and gets (or will get) it approved, why can't you extend your H-1B before it expires? Why do you need the EAD if you are in H-1B? Does your employer pay the EAD fee?

-------------poster has not joined new employer with H1 transfer, joined with EAD. He cant file H1 extension according to the the info provided by the poster.

If so and gets (or will get) it approved, why can't you extend your H-1B before it expires? Why do you do need the EAD if you are in H-1B? Does your employer pay the EAD fee?
