H1 expiry and H4 stamping...Please help

Hi All,

I'm planning India trip to get marry in Nov 2002 and would like to come back on or before Dec 21 2002 and at the same I would also like to bring my wife along with me.But,my current H1 expires on Feb 1 2003 which is very close to my vacation end date(i.e Dec 21 2002).

Since I'll be very close to my H1 expiry,will it create any problem for me or my wife on our way back to US?

Will the consulate issue H4 to my wife for this very short
period(i.e 1 month)?

Also,I have another H1 approval (not stamped in passport)notice from another company upto year 2004.

I have not applied for H1 extension from the current company because I would like to change the company after I come back from India.

Can anyone suggest me how do I make my India trip safe by considering all the above visa issues

Options

1. One month remaining is not a big deal. You can tell them (and assure them) that you will file the necessary extension after coming into US (including for h4)

2. However if you are planning to change job, you might as well get the new h1 stamp and get h4 based on the new h1 stamp, if you have all the required papers from new company. I think you can have a future starting date for the new job (not very far in the future but like within a month from stamping date...)
 
H1 Revalidation

Could you please tell me whether I'm eligible to apply for H1 revalidation here in US for my new H1?(i.e 5 months prior to visa expiry)

I have got all the required documents from the new employer.I'm thinking of get stamped here in US, but I want to join the company after I come back from India.

Will Dept of State issue visa if I apply it now?

H1 revalidation in Mumbai?

Hi All and Jaxen!
I am traveling to India this week and will be back early september. My H1 expires March 3 2003. I will be getting married and applying for my wifes H4 at mumbai consulate. Is it possible and advisable to apply for H1 revalidation in India along with H4 for my wife so I am saved of revalidation trouble for 2 visas. I believe i need to have LCA approved for H1 revalidation. Please Jaxen if you can provide some more info on the documentation and procedures for revalidation.

Hi pendli , No. you can validate visa in usa only before 60 days before your current H1 stamp on passport expire.


Hi immiadvice, may be I am missing something, but you need to have new h1 approval to validate visa, Do you have h1 ext approval with you ? If you are talking about getting new stamp on passport to reflect your h1 apporval it can be done in India, the document requirement remain same and can be found at www.immihelp.com

My H1 visa and I129 are expiring at same time i.e Jan'2003.

Can I get them validated in India say in Novemeber since I will there for over a month.
