H1 expiring

H1 expiring...Please help !!!

Hi,

My H1B ends in July 2005, my GC processing is on its way...i have got my EAD meanwhile. I filed for 140 and 485 in January 2004.

Now, do i extend my H1? If so, how do i do it?
I did not get my present company's H1 stamped on my passport yet. Is it necessary?

I would really appreciate any help in this matter.

----- If you need to be safe it is better to extend H1, because your I-140 is not approved and if unfortunately I-140 gets denied your EAD, AP, I-485 all will be denied. Best option don’t use EAD till I-140 gets approved and maintain H1 status, you can extend H1 status and you are also eligible for 7th year H1 extension on the base of pending I-485
If so, how do I do it?
----- Your H1 is valid till July 2005 you can file H1 extension 6 months advance of your H1 expiry or I-94 expiry or any day before your I-94 expire, it is better to file 5-6 months advance as service center is taking 5-7 months to send approval notice. Your employer has to get LCA from DOL and lawyer can get it in 2-3 days from DOL as it is faxback system once employer/lawyer gets LCA then employer /lawyer has to file your H1 extension with USCIS

--- Not necessary for H1 extension but if you go out you need Visa stamp to renter on H1, if your stamp has not expired more than 1 year you can send your passport to DOS in US for Visa stamp revalidation
