H1 examption subject to H1 Cap?

Hi:

I will participate the national residency match, which will occur on 3/15/04. I intended to apply H1 if I could match with a program.

The hospitals I interviewed with all are H1 exempted programs. But one hospital director told me they might still be subjected to the H1 Cap (He was not quite sure), which means if the Cap has been reached, they could not even file a H1 application even though their program is H1 Exempted. Is that true?

Is H1 examption subject to H1 Cap? Are there sub-categories under H1 Exemption that some are exempted and some are not.

There is no such thing as H1 exemption. Its only exemption from the cap (i.e. quota). Some residency programs (usually university programs) are cap exempt. That particular program director you mention is clueless about immigration matters. Ask him/her to ask their attorneys.

By the way, the cap has been reached today.
