H1 documents required for application

I am currently on F1 visa with my OPT, and my employer is right now applying for my H1 visa. I have submitted to him the copies of these required documents: Passport pages for identification, Visa page from passport, Copy of I94 front and back, I 20 form, Masters degree certificate and transcripts from a US university, bachelors degree certificate and transcripts from Univ. of Bombay in India, Drivers License from State MI, Copy of the EAD card (since I am on my OPT), and a current resume. I do not have my Certificate of birth, 12th standard (HSC) and 10th standard (SSC) diplomas/marksheets with me currently. My employer is asking for those to be submitted with my petition to the INS. ARE any of these 3 documents ABSOLUTELY required with the H1 petition? Is the application likely to be not approved only because these 3 documents are missing? I searched for the requirements of documents for H1 on different websites, but None of those say that any of these 3 documents are required? Can anyone confirm that their application was rejected or replied with a "More information requested' reply from the INS due to these 3 documents.

----- The documents you submitted are enough for H1B filing, Birth certificate is NOT needed, you will need Birth certificate only for filing last stage of Green card with I-485 filing then you will need Birth certificate or non availability certificate of birth certificate AND 2 affidavits by your parents or elder relatives on 10 rupee stamp paper (if you are from India)

----- Employer is wrong lawyer will be able to file H1b without birth certificate and H1 filing regulation don’t need Birth certificate for H1 filing employer is completely wrong

----- USCIS does NOT need BC and will not reject H1B because of not having Birth certificate, as it is not required for filing H1

** may be employer not intrested in filing H1 and search new employer or talk to lawyer directly

Thanks for your reply. I just wanted to get this information confirmed before I confront them in this matter.

Sorry for the repetition of my question, but can you ALSO confirm about the -

(1). 12th standard(HSC) and

(2). 10th standard (SSC/High school) certificates from India,

Are these optional, or are they required to be submitted with the petition? I have already submitted to them my Bachelors (4 year) degree certificate and transcripts from University of Bombay, plus my Masters degree certificate and transcripts from a US university, both the degrees are in my field of occupation, so I dont know why they are insisting on the 12th/10th standard diplomas? The Employer said to me that the INS requires them to Verify the Date of Birth either from those diplomas / or from the birth certificate "along" with the date of birth on the passport. So that surprised me so as to why would they not verify the date of birth from so many other submitted documents, including the Passport, the Visa Page, the current EAD card (issued by INS for OPT), Drivers license (state of Michigan), I20 form with the F1 visa, etc.? As you said, they could be misleading me for whatever reasons, and so I needed to confirm this information with someone who may have past experience or knowlegde in dealing with the documents required for the H1 processing. Your input in this matter would be highly appreciated. Thanks!
