H1 correction of expiry date and the time it takes...

Hi there,

My H1 has been approved for more than required amount of time. Do anybody there know what the procedure is, to get it rectified?

let me explain a bit clearly: I got my H1 till July 2008, which is beyond my 6 years. It should have been only till June 2007. How can I go about to request a change for that end date?
Also, how long would it take, is it same like applying for a h1 or transftering an H1?

Please anybody out there who must have gone thru the same situation, do respond.

You need to file another H1 petition(I-129) with amendment.
If it was the mistake on CIS side, you check "correcting error of CIS" checkbox of I-129 and let them fix it. No fee charged in this case.

I have a question on the answer that you gave....that is, how would I know its the mistake of the CIS? I am pretty sure its not their mistake....it is the attorney who might have screwd up, without looking at my previous H1's and my entry and departure record into US. In any case, how can I tell on who's part the mistake lies??

Is there a way to verify who made the screw up?

Can I blame the Attorneys who are now taking care of my GC? will it annoy them and possibly could finger my GC process!!!! :-(
 
If you have labor certificate application which is over 365days old, or approved I-140 petition, it makes sense that lawyer asked petition longer than 6th years. Check your LC or I-140 status.
