H1 Cap

Hi All,

Does the INS keep a track of giving H1 approvals to be within the cap (65000) or does the consulate in each country decide and keep a track of visas to be issued within the cap

I am asking this because does it matter which time of the year that I go for initial stamping of H1 (I already have a H1 approval and am already in the US). For example if I go in September, will there be a chance that the quota might have got over.

So my question do the INS give more than 65000 H1 approvals but only gives 65000 H1 visas or does the INS give H1 approvals not more than 65000 each year.

Could anybody clarify this for me.

Does that mean that INS will not give more than 65000 H1 approvals this year? So i dont have to worry about being in the quota to get my initial H1 visa stamped. Am i already in the quota?

Visa quota has nothing to do with visa stamping.
Since you already got H1b approval, you NEED NOT WORRY about it.
