Hi,
My 6-year h1 is supposed to end in March 2003. But, during my last H1 renewal INS gave approval notice until January 2004. Is this O.K. During revalidation I got H1 stamp in my passport until Jan 2004.
do I still need to get new H1 from my employer for 7th year (my 485 is pending with INS), before March 2003.
thanks for your time,
-Ramesh

Yes U need to get a separate extension filed if your LC is pending for more than a year. If no immigration petition or LC is pending you will have to leave US and come back after 1 full year. The onus of maintaining 6 yr is on you.

If you stay beyond 6 yrs without a fresh extension and INS finds out after few years (it will be a matter of verifying the record), you will be considered as accumulating Out of Status days and might be barred for 3 to 10 years from US.
