H1-B2 trouble at the last moment!!

Hello Ginnu and other Gurus,

Some guys gave me tense moments at the eleventh hour !!!

My current employer has filed for H1 transfer. My sister wants to visit me from India. She has her Consulate interview for b2 in 2 days at Delhi. Will there be any problem for her B2 visa if my H1 transfer is pending.

H1 from my last employer is valid till July 2004. My sister wants to visit me from March to May'2004.

------ your H1 transfer has nothing to do with her B2 visa, she has to prove ties to home country and consulate officer looking at her age will decide to give Visa or refuse the Visa because every visitor is supposed to be having immigration intent and visa officer has to decide, you cannot do anything.

----- Her Visitor visa is not being granted on your status even if you are Citizen or GC holder she can be denied Visa, all depends on visa officer and if she can satisfy the visa officer that she will return, if she is married or has government job or good known company job in India and has her home or children in India she may get visa, nobody can give you guarantee that she will get Visa. She will only know the result after she goes for interview

I've been hearing lots of conflicting opinions regarding my pending H1. But your point makes perfect sense. Avisitor visa is a visitor visa, it has nothing to do with my H1. I'm only required to show that I will support her while she is here...

BTW, She does not work in India, but she has her Husband who is a government doctor and a 8 year old son in India. That's my only hope...

I was so worried that she could be denied just because I did not take care of things from my side...

My sister was granted B2 Visa at Delhi consulate yesterday.
I had a pending H1. As ginnu said, it did not make any difference at all. She had strong reasons to return to India. Not big bank balance. I guess that worked in her favour....
