H1 B visa issue to I-94

Hi,

I am currently on H4 visa in US. I applied for H1 B visa in Apr 2007 and I got the receipt number. But I had to go to India in August and came back on Sept 14. On Sept 26th, my petition was approved, but not eligible for the change of the status. I understand that as I left US change of status request was abandoned. Please correct me if I am wrong.

My employer had filed a motion to reopen. I have been advised to go to US consulate in Toronto. Could you please tell me what is the best option for me? I am concerned of any denials at the consoluate in Toronto.

Yes, your adjustment of status was abandoned and a MTR isn't going to help. Just go to Canada or Mexico and get a stamp and re-enter the US.
 
Hi,

In few sites, I read that there are lot of rejections in Toronto. But, I have been advised to go to Toronto in the notice. Will there be more chances of rejection for me because of my current H4 status?
 
Visa appointment in calgary

Hi,

I have got appointment in calgary. could someone please tell me what are chances for me to get visa? my request for change of statues was denied as i travelled to india in between.
 
BTW - there is no difference in visa processing between Toronto and Calgary. I don't forsee any issues as you never went out of status.
 
They have mentioned that if i go to a consulate other than toronto, the employer has to file I-824 form. But in my case, this is not done. Will this be a reason for denying the visa. Please reply.
