H1 B Transfer

Hello Mr. Rajeev Khanna,

I take this opportunity to thank you for all your valuable advise to the immigration community. I really appreciate it.

I have the following questions:

1) How significant the pay stub in H1B transfer? Is there any way the H1B transfer can be done without pay stub?

2) If a candidate has a vaild H1 Visa with an employer " A". The candidate is out of job. In the mean time , the candidate got a job with a company "Y". As per INS rules of H1B transfer , the candidate should submit all the docs necesary along with a latest pay stub. Since he is out of job( say for more than 10 months), he has submitted all the documents except pay stub to the company "Y". The company " Y" has applied for H1B transfer ti the INS without pay stud. The company "Y" got a receipt notice.
Can I asume that his H1B will be approved as he got the receipt notice?

2) in case the H1B appraval gets rejected, what is the status of the candidate? ( Do you advise him to go back to the previous employer " X", if the company X did not cancel his H1B?)

3)Since the company " Y" has got the receipt notice, the candidate started working with the new employer" Y". Now he has a vaild H1B receipt notice and a valid pay stub. If he get another job offer with a company " Z" will new H1B approval with company "Z" is gauranteed as the candiate submitted all the docs along with the pay stub if the company apply for H1B transfer from company " Y" to " Z"?

H-1B Transfer

1. Producing your most recent pay stabs to INS is very important. The reason being that this is the only way to prove to INS that you have been in status


2. No, the receipt notice does not guarantee approval of your petition. It is merely a notification that INS has received your application.
