I am presently working on a H-1B with a small company as a Mechanical Engineer. This is my second company after I trasfered my H-1B from my old company(which sponsored my H-1B) a little over a year back. Now I found a job with a bigger company and they applied for my H-1B transfer and got my receipt this week. I submitted my resignation with 2 week notice to my present company. They are not happy with my decision to move, and offered me counter-offer with more salary and other benefits. After 2 days (today) I decided not to take there offer due to my long-term plans. In the mean time I came to know that my present employer contacted there attornies and trying to find a legal loop hole to keep me here by any means. I am thinking that they don't want me to work for this bigger company as it is one of the biggest customer of my present company and they are not too happy taking my expertise to them. Moreover I am in a unique field and it would be very very tough for my present company to find a replacement for me who would be as qualified or better than me.
After understanding that they can't stop me from working with there customer they called me today and requested me to extend by 2week notice by another 2 weeks. It means they want me to work until Feb 24th instead of 10th. In the mean time they have removed a lot of my computer access privileges which is not allowing me to work efficiently. Anyway I decided that i will not oblige there request and work only until 10th.
My concern now is that I suspect that they are trying to send a letter to BCIS asking to terminate my VISA before I can get onto the payroll of this bigger company. If they are able to do it before I can start working with this other company will I still be able to start working with the other company based on the receipt. What are the repercussions of my present company actions. Can someone please guide me ASAP. I am really tensed and am not sure what to do. Should I contact my new company about this. I would really appreciate experts help on this forum.
