H1-B Transfer Rejected -- Please Help

Hi All,

I came to US on company A's H1-B visa on Feb 2003. I got an offer from company B and Company B filed for my H1-B transfer on 15th Sept. 2004. I started working for company B on transfer receipt. INS raised an RFE which company B replied, but i just came to know yesterday that my H1-B visa is rejected by INS. I still hold company A's H1-B which is valid till Mar,2006 but i no longer work for company A since 15th Sept 2004.

1) I would like to know my present H1 status ?

2) What is the solution to my problem if i want to stay in US and continue working ?

3) Can i apply for fresh H1-B for transfer Company C on basis of my company A's visa ?

These are complicated questions and get yourself a good attorney. You can apply for Motion to Re-open the case, but you need to give additinal evidence and prepare a good appeal. Most important thing is reason for rejection. If you think you can overcome the reason by providing more evidence, then MTR might be good. Anyway, get yourself a damn good attorney.

Try to know why the RFE was rejected? Find out whose deficency Yours? or Employers. Which will give you more solutions to go to company C.
