H1-B to F-2

I am an H1-B laid off on Nov 1st (INS has not been notified and my H1-B stamp is still valid, so is my I-94). I got married last week and my wife has an F-1 visa and I would like to apply for an F-2 now. What are my chances and how should I go about this? What options do I have? Do I have better chances with a new H1-B application, in case I find work until then?

Many thanks!

Sean

Depends on the consulate where you are applying

For a F2 the Non immigration content should be loud and clear. There is also a 30 day 60 day rule which says that if you apply for a change of visa within 30/60 days you wilfully lied while applying for F2. With a H1 already in your name it is quite possible that the visa officer will question you whether you will try for a H1B after entering US under F2.
IMHO wait for H1. Once again, This is my opinion.
