H1-B to EAD Transition HELP!

Hi everyone!

My H1-B expires on May 10, 2006. I am waiting for my I-485 and my EAD approval. Check out my timelines.

Here is my question. On May 11,2006, I understand I need to stop working. My HR contact is suggesting I take Paid Time Off (PTO) until I get an iEAD or if my EAD gets approved.

Is this possible? Or should I take a "leave of absence". I would rather be off the payroll as I think that is the legal way of doing things. Can someone please let me know what the rules are or point me to the right direction?

If I were you, I would want to be terminated by your employer on May 10 and keep working as a 1099-paid. Even if you take PTO you are still on the company's payroll.

By looking at your timeline, I suppose you should receive your EAD any day.

The only potential problem that I see is that you will temporarily lose your health insurance and then probably have to wait for 3 more months to get it back.
