H1 B stay beyond I-94

Hi,

My visa expires on Nov 3.
My I-94 date is stamped till Nov 13.
I have applied for H1-B extension on Sep10th.
I haven't received any acknowledgement as yet.

Can I leave USA without having an acknowledgement in hand after Nov 13th which is the I-94 date ?

-------------That is ok if your lawyer sent H1 extension papers to USCIS Before I-94 expiry date
I haven't received any acknowledgement as yet.
------- talk to lawyer he may have got filing reciept
Can I leave USA without having an acknowledgement in hand after Nov 13th which is the I-94 date ?
---------- you can remain in US and can work on H1 if extension is filed

Again, i want to go back to india around nov 20th and come back after restamping....is it ok to leave around 20th November (which is past the I-94 date) - without the acknowledgement in hand ?

--------------- check with your lawyer if he filed H1 extension( I know a case the H1 Extension was not filed on time and person was staying illegaly, mistake of lawyer) If you get H1 Ext filing reciept then you can go on 20th if not better go out before Nov 13 or I-94 expiry date. Take the full petition copy of H1 extension certified by lawyer( LCA and I-129 from your lawyer) and other documents for H1 Visa stamping. you will need H1 approved to be sent to you.
