H1-B status: Laid off before I started working

Hi,

I was working with company A on H1-B visa stamped on my passport. Had to go overseas for an assignment. After the assignment I was supposed to get laid off. I found company B who sponsored my H1. So I re-entered the US on company B's H1-B approval notice and company A's visa.

Now company B took back their offer. So I could not even start working for them. Company A as part of the severance will pay me till end of September.

What is my status right now and how much time do I have before I have to change status (viz: F1, J1, etc).

Technically speaking you do not have any grace period. You are out of status right now. But on the other hand since INS might not have any knowledge about your lay-off you could still look around for a new job. Act fast.

But since I'll be on the payroll in status "inactive" for company A for 2 more months, does that buy me more time? Will be 'in status' till the time I'm in the payroll?

This is not true. INS requires companies to pay their H1-B employees. If one does not get paid, he/she becomes out of status immediately.
