H1-B Question

My employer is filing my H1-B. Today I got a copy of 1-797C, Notice of Action and it has a 'Receipt Number'.

Received Date: July 14, 2006
Notice Date: JUly 19, 2006

Can someone tell me how long will it take now for me to get the H1-B and also does this mean I can work on H1-B with start date of Oct 1, 2006?

Also in the present time do I work on OPT which expires on June 2007?

to start working on Oct 1, you need to meet the following condition.
1. your approved petition has start date with Oct 1.
2. you have approved petition upon Oct 1.
 
You can start working right away on your OPT.

From Oct 1st 2006, once your H1 is approved, you continue working on H1. I do not think you can move onto H1 after your F1 OPT expires, OPT becomes valid rightaway. The only thing is you cannot avail F1 benefits (tax exemption, etc) once you move onto H1. Other things remain same.

I have a question regarding the H1 visa.I am currently on OPT and not working anywhere.My OPT expires on May 10th 2007.And all the H1 B Visa quota has been filled for this year.If i get hired now i can work on OPT till May 2007.but if my employer files my H1 Visa in April 2007 then i will get my H1 Visa in Oct 2007.What will happen in the time period from May 2007 i.e. from the time my OPT expires until i get my H1 Visa(oct 2007)?Can i still work for him as he has filed for my H1 or will i be illegal in the US?In this case what should i do?

Hi,
I have a question regarding the H1B Transfer. I am currently employed by a university on H1B and have an offer from a non-cap exempt company. I understand that the cap for 2006 is over, even for the advanced degree. I will really appreciate if you could tell me when can I start working. Since I already have H1B, under the protability provisions, can I start working in April 2007 for the new employer when the application process starts or do I have to wait till October 2007. I will really appreciate your response.

asad2282, you will not be illegal, however, you are not allowed to work from the time your OPT expires to the time of your H1B start date. If you file the H1B in April 2007 with premium processing, you will get an answer from USCIS in 15 business days. If you don't use premium processing, then it will be a many months (Not necessarily Oct 2007 like you stated, it could be later).
