H1 B over Cap Situation - plz ans!!

Hi All,
My OPT will expire on December 07. My company has applied for my H1 B with my BS degree only. Now if because of random selection my H1 is not selected and therefore rejected what will happen?? What will be my status after Dec 07?? Will I have to leave US??

Please let me know your idea/suggestions in this regard.

H1B cap for advanced degree

I have couple of questions

1) For advanced degree quota is it first come first serve basis or even they will be put under lottery when the number of applications exceed 20000?
2)As per the press release on April 5th they have sorted 27000 regular applications and around 4700 under advanced degree quota. Since I have already received my receipt number, does it mean that I am one of those 4700 applications. And if the advanded degree quota is first come first server basis, then I am already in the quota.

When did your employer/attorney-firm actually applied? March-31 or April 2?

Did you get the receipt in mail or email?

Is is application done in premium processing?

I was told that if 20k is not reached on April 2nd, then U_MS application on April 2nd are safe but if ther eare 20k+ apps on April 2nd, then there will be lottery.
 
For masters degree quota it is posted that the first 20000 applications will be excempt from the cap. Doesn't it mean that it is first come first serve basis for the advanced degree quota. If there are 20K + applications, then how will they take lottery? Lottery in advanced degree quota doesnt make any sense.

Example: Think that there were only 90 K applications received on the first day and of them 40K are advanced degree quota. Does it mean that these 40K will have a lottery and the remaining 50K who are in general quota directly in within the cap. what I thought was that the first 20K of the 40K are in the quota nd the remaining 20K along with the other 50k are pooled into one lot and taken for lottery.

When I read the requirements and details about advanced degree quota it looked as if it is first come first serve basis.

By the way I got my receipt on April 3rd and the application was received on April 2nd by INS.

Just curious:

HOw did you get your receipt so soon ? by mail from UUSCIS or email or fedex?

or your attoeney got it? or your employer or you?

Anyway, if there is over 20K + apps in Mar-31, April 2 and 3, there will be total lottery

If there is less than 20k US-MS on and by April 2, you are all set!

Congratulations on your receipt.
All major law firms and the AILA have said that getting a receipt number doesn't mean a thing. If you know your application reached USCIS on the 2nd or 3rd, your in the lottery (or started processing if your in the first 20,000 US/Masters). Otherwise, try again next year.
