H1-B for young french citizen with bachelor

Hi,

I have just finish a bachelor of information system in France, I a 22 year old. I am actually working in USA with a J-1 Visa, this Visa expire in september 30th 2004. The company want to keep me, for a computer job (salary: 40000$ a year). I want to apply for an H1-B visa, when is the best period to apply ?
Do you think I have a good chance to get this Visa or not ?
Give me some tips please :)

First of all, being on J1, are you subject to the 2 year Home Residency Rule?

If yes, then you have to obtain waiver from this rule and after that only, you can apply for H1B.

If you are not subject to the above rule, then you can apply.However, no one can be sure or guarantee that your H1B will be approved.

No, I am no subject to that, I have just do a simple J1 Visa for 4 month summer work.
So how many percent of chance I have to get the H1-B Visa ?? 10% ??50% ?? 80%

It is good that you are not subject to the HRR.Hence,your currently being on J1 has no effect on your H1B petition.

If you are well qualified and meet all the criteria for H1B,it then depends on the USCIS.So, no one can give you the percentage.

I will let you in on a secret though: Just apply for H1B and see what happens.If it gets approved, then you had 100% chance. :D

I think you would be just wasting your time for nothing by going through any statistics as each case is different.

If you meet all the criteria for H1B, then why fear?? Go ahead, apply and see what happens.If it gets approved, excellent,if not, then you would have to go back to France( or seek another alternative) which you would do anyway,even if you do not apply for H1B.
