I am wondering whether one can deduct the lawyer charge (retainer) and the filing fee as a itemize deduction?

I think that you Can NOt deduct any legal fees.Check in google for "Employee business expences"
I am in the same situation like you.

This is what I was told from someone who does taxes for a lot of people when she looked it up.

The rule is: "a legal expense is deductible if the issue arose in the course of your business or employment". Thus, since it is for your work permit I would say that yes you can deduct it. It would fall under the miscellaneous expense section of the itemized deductions.
 
Actually, you cant deduct this expense. I had the same doubt more than a year ago and I contacted IRS over the phone. Though I didn't get a immediate response, one of their agents called me up and informed that I can't ask for a deduction though I paid for legal expenses. If you still have doubts you can contact IRS.
