I was offered a job with company A and they agreed to sponsor my H1-B but they made me sign an offer letter stating that I would refund all the expenses from this sponsorship if I left the job within 2 years.
I was then offered a job with company B which pays better and is a better opportunity. By that time, company A mailed my H1B papers to INS. Two days later I informed company A that i am not joining their company. They sent me a written notice that I should pay $4300 immediately.
Now my question is, am I really required to pay that amount as I signed the offer letter?? Also does INS refund the fee to the company A if the case is withdrawn before the receipt number is assigned to it?If so, am I still responsible for those expenses?
