H1-B Extension

Hi Guys,

I am working on a H1-B visa right now which expires on Mar 10th . I am going to apply for my extension in another couple of weeks. My problem is I am planning to travel to India after applying for extension and wil be back before my current H1-B expires. So, Is there gonna be any problem with my travel to India , while my case is in pending state. Also, I am planning to apply for Visa revalidation/stamping only after coming to US with DOS . So, will there be any problem with my stamping if I have a new I-94 issued at the POE while entering the US. Please let me know if anybody have undergone this situation.

------------ Bette apply for Revalidation when you get the H1 extension approved, you will have new I-94 attached and extended with your H1 extension approval. You will have two I-94, one that you will get when you enter US from trip While color and other I-94 will be attached with your H1 extension approval notice, detach that I-94 from approval notice and staple that I-94 in your Passport. Staple the new I-94 in same passport page that will have White I-94 attached (it means two I-94 new one at top) and send the Passport for revalidation with other documents

Hi ,

I had talked to Attorney murthy about this, and it looks like there is a slight risk on traveling after applying for the extension. Assume, before I enter US, if my H1-B gets approved at BCIS, then while entering I will be getting a new I-94 which invalidates the I-94 which will be coming along with the approval notice. In that case, I might have to travel again abroad to get my Visa stamped. So, I am planning to go only on Dec , I am going to wait to see if I get my approval notice before that. If I get them , I will get stamping in the Consulate or else I would cancel my trip. So, I would like to know if there is any risk associated if I get stamping in the consulate instead of sending it here . I would appreciate if you can help.
