H1-B Extension & Travel

I recently filed an application to extend (for the second term) my H1-B which expires in Jan 2004. My application was sent over to INS on August 4th, 2003. I am told that it will take about 6 – 8 weeks to get my H1-B extention approval. Once I get my approval I plan to send my passport to St. Loius for the stamp. In the mean time I have to travel outside the country on work. Is it advisable to travel outside the country while my extension is being processed. Please help!! I have to go outside the country for 1 week really soon. Thanks.

After filing the extension of H1 you can go out US and can enter US with valid H1 visa in PP. Only change of status is abandoned not extension of status if you leave US.

If H1 is approved when you are out of US then request your employer to send Approval notice to you and At POE show passport Visa and new H1 approval you will get I-94 till the H1 approval notice.

If the H1 is approved when you are back in US no problem you will get new I-94 attached with approval
