I am on H1b in 6th year.My employer filed I 140 and got approved an year ago. As my H1 is expiring in Jan 2010 my employer filed for H1B extension in Dec 2009 based on I-140. USCIS has issued RFE asking my employer tax returns , how do they supervise me on client side and what is the relation between vendor and client.
They also asked my w2's and tax returns for the year 2008,2009.
My LCA states my wages as 50k per year,for year 2008, my w2 was 22k(I was in USA the completed year) and year 2009 have 51k.
I request your help to defend this case, are there any chances of proving this case where my w2 is below prevaling wage for year 2008. if so what are the options.
