H1 b & EAD

if incase this H1b ban will get approved do people working on EAD also get effected or they r still safe?
 
according to the h1b ban bill US WORKERS MEANS 1.is a citizen or national of US 2.is an alien who is admitted for permanent residence or is an immigrant

does EAD fit in definition of US workers...........is EAD holder is considered as IMMIGRANT?
 
Got a question...

EAD is expiring in August and H-1 is expiring end of this year. Currently still working under H-1. Plan to renew either one soon. If I renew EAD and in worst case I-485 got rejected, can I still go back to H-1 with current employer? Will have used around three years by end of this year. If so is it considered renewal or reapplication for H-1?

To Ramprak : The proposed bill defines US worker as 1)citizens 2)GC holders 3) Any other person authorized by BCIS to work in America. So don't worry too much about other jargon (like if EAD comes under immigrant category).

To xdai : Always safe to have EAD. costs you only $120. Don't speculate about I485 rejection unless you have done a lot of fraud. In case I485 is rejected because of some criminal records here, then it will not affect your H1. The standards are different for both. You can simply renew your H1 (no need to file for a new one) provided you file it before the current H1 expires.
 
dsatish: Thanks. Certainly no criminal records or fradulent conduct. But in worst case if I-485 doesn't get adjudicated this year (although my RD is March 2002. But who knows what will happen?) and is rejected next year, as you will see my H-1B would have been expired then if I don't renew it, will I be able to renew it then or I have to file for a new H-1, assuming I have renewed my EAD? This is the question I asked in the first place.

I guess you did not read my post fully. I answered that you have to renew your H1 before it expires( that means by December). Otherwise, you will have to file a fresh H1 in February. I think things will be clear to you by beginning of December. If you are not approved by then, better renew your H1.
