H1-b cap exemption

Hello,

I previously held an H1-b visa from 3-00 to 11-01, returned to Canada for 10 months, then entered the US in 09-02 under a TN visa (present status expires 09-04).

Currently I found an employer willing to support me on an H1-b visa.

Am I exepmt from the 65k h1b cap that ended in Feb? Or do I have to wait until Oct.04 before I can work for my new employer?

You are exempt becuase you were outside USA for less than 1 year.
